Welcome to Elysian Destinations! By accessing my website, using my services, or making any bookings through me, you agree to be bound by the following Terms and Conditions. Please read them carefully.
1. Definitions
"Agency," "We," "Us," "Our", “Me”, “I”: Refers to Elysian Destinations.
"Client," "You," "Your": Refers to the individual(s) or entity making a booking or inquiry through the Agency.
"Suppliers": Refers to third-party providers of travel services, including but not limited to airlines, hotels, cruise lines, tour operators, car rental companies, and insurance providers.
"Services": Refers to the travel planning, booking, and related services provided by the Agency.
"Booking": Refers to any confirmed reservation for travel services made through the Agency.
2. Acceptance of Terms
By engaging with my Services, you confirm that you have read, understood, and agreed to these Terms and Conditions.
These Terms and Conditions apply to all bookings made with me and supersede any prior agreements or representations.
3. Our Role as Agent
I act as an agent for the various Suppliers. This means that when you make a booking, your contract for the travel services (e.g., flight, hotel, cruise) is directly with the respective Supplier(s).
I am not responsible for the acts, omissions, or failures of any Supplier. Your rights and remedies will be governed by the terms and conditions of the relevant Supplier.
4. Booking and Payment
Pricing: All prices are subject to change until full payment is received. Prices may not include taxes, fees, or charges imposed by third parties (e.g., resort fees, baggage fees), unless explicitly stated.
Deposits & Full Payment: Details regarding required deposits, payment schedules, and final payment due dates will be provided at the time of booking. Failure to make payments by the due date may result in cancellation of your booking by the Supplier or me.
Payment Methods: Specify accepted payment methods (e.g., credit card, bank transfer).
Confirmation: Bookings are confirmed only upon receipt of full payment (or required deposit) and issuance of a confirmation by the Supplier.
5. Cancellations, Changes, and Refunds
Client-Initiated Cancellations/Changes: Any cancellation or change requests must be submitted to me in writing.
Supplier Policies: All cancellations and changes are subject to the terms and conditions of the individual Suppliers, which may include cancellation fees, non-refundable deposits, or full payment forfeiture. Supplier Terms and Conditions will be provided to you and MUST be read and accepted before booking is made.
Agency Fees: We reserve the right to charge a reasonable administrative fee for any cancellations or changes processed by me on your behalf.
Refunds: Refunds (if any) are processed according to the Supplier's policies and may take time to be remitted. There are no Agency fees.
Agency/Supplier-Initiated Cancellations/Changes: We are not liable for any cancellations, changes, delays, or disruptions initiated by Suppliers (e.g., airline schedule changes, hotel overbooking). I will, however, endeavor to assist you in resolving such issues.
6. Travel Documents and Requirements
Client Responsibility: It is solely your responsibility to ensure you possess all necessary valid passports, visas, health certificates, travel advisories, and any other travel documents required for your itinerary.

Passport Validity: Ensure your passport is valid for at least six months beyond your intended return date from your final international destination. Many countries enforce this "six-month rule," and an expired or soon-to-expire passport can prevent you from boarding your flight or entering a country. Visa/Entry Requirements: Successful international travel hinges on understanding and fulfilling the specific visa and entry requirements for each country you plan to visit or transit through. These regulations are set by individual nations and can vary widely based on your nationality, purpose of travel (tourism, business, study, etc.), and duration of stay. Failure to meet these requirements can result in denied boarding, significant delays, or even denied entry upon arrival.

Determine Visa Necessity: Research whether a visa is required for your nationality to enter each country on your itinerary, including any transit points where you might clear immigration. Some countries offer visa-free entry for certain nationalities, while others require a visa obtained in advance, either from an embassy/consulate or through an online e-visa system. Some may offer a "visa on arrival," but it's crucial to confirm eligibility and any associated fees or procedures.
Understand Visa Types and Purpose of Travel: Ensure the visa you apply for (if required) matches the purpose of your trip. A tourist visa, for example, will not permit you to work or study in a foreign country.
Check Specific Entry Conditions: Beyond visas, countries may have other entry conditions, such as:
Proof of onward or return ticket: Many countries require evidence that you intend to leave.
Proof of sufficient funds: You may need to demonstrate you have adequate financial means to support yourself during your stay.
Hotel bookings or accommodation details: Some destinations require confirmed lodging.
Travel itinerary: A detailed plan of your trip may be requested.
Apply for Visas Well in Advance: Visa application processes can be lengthy and involve submitting various documents, photographs, and attending interviews. Do not wait until the last minute. We recommend starting the visa application process as soon as your travel plans are firm.
Monitor for Changes: Immigration and visa policies can change frequently. Regularly check the official government websites of your destination countries (e.g., their embassy or consulate in your home country) for the most current information leading up to and during your trip.
Health Requirements: I want to ensure you have a safe and healthy journey. As your travel plans may involve international or domestic destinations with varying health considerations, it is crucial that you, as the traveler, take responsibility for understanding and complying with all relevant health advisories and vaccination requirements for your chosen destination(s).

Before your departure, I strongly advise you to:
Consult Official Sources: Refer to the official websites of government health organizations (e.g., the Centers for Disease Control and Prevention - CDC in the United States, or your country's equivalent) and the embassy or consulate of your destination country. These are the most reliable sources for up-to-date information on recommended and required vaccinations, health precautions, and any current disease outbreaks or health-related entry restrictions.
Schedule a Medical Consultation: We recommend scheduling an appointment with your healthcare provider or a travel clinic at least 4-6 weeks before your trip. They can assess your individual health needs, provide personalized advice, and administer any necessary vaccinations or preventative medications.
Understand Vaccination Requirements: Be aware that some countries require proof of certain vaccinations (e.g., Yellow Fever) for entry. Failure to provide such proof may result in denied entry or quarantine.
Monitor Health Advisories: Health situations can change rapidly. Continuously monitor health advisories and travel warnings issued by your government and international health organizations leading up to your departure and even during your trip.

Therefore, it is ultimately your responsibility to verify and fulfill all health-related entry requirements and take necessary precautions for your travel.

Driving Licenses: If you plan to drive a vehicle during your travels, whether renting a car or operating your own, it is essential to understand the specific driving license requirements for your destination(s). Regulations vary significantly by country, and failure to comply can lead to fines, legal issues, or denied car rental.

Check Destination-Specific Requirements: Every country has its own rules regarding foreign driver's licenses. Your domestic driver's license may be sufficient in some countries (e.g., Canada and Mexico for U.S. licenses), while others will require an International Driving Permit (IDP) in addition to your valid domestic license. Some countries may even require you to obtain a local license if you plan to stay for an extended period.
Obtain an International Driving Permit (IDP) if Needed: An IDP is a document that translates your government-issued driver's license into multiple languages. It is not a standalone license but must be carried alongside your valid domestic driver's license. In the United States, IDPs are issued by authorized organizations like the American Automobile Association (AAA) and the American Automobile Touring Alliance (AATA). You must obtain your IDP in the same country that issued your original driver's license before you travel.
Be Aware of Car Rental Company Policies: Even if a country's law doesn't strictly require an IDP, many car rental companies may still insist on seeing one before they will rent you a vehicle. Having an IDP can prevent unexpected hassles at the rental counter.
Understand Validity Periods: Your domestic license or IDP may only be valid for a limited period for tourists in a foreign country. If you plan a longer stay, you might need to obtain a local driver's license.
Carry Both Documents: If you obtain an IDP, always carry both your valid domestic driver's license and your IDP when driving abroad.
Research Road Rules: Familiarize yourself with the local traffic laws, road signs, and driving customs of your destination to ensure a safe and legal driving experience
7. Travel Insurance
Highly Recommended: I strongly recommend that all clients purchase comprehensive travel insurance at the time of booking. I do not offer travel insurance policies but I can guide you through the process of selecting a plan through trusted partners.
Coverage: While some credit cards offer travel insurance benefits, it's important to understand that these policies often have limitations in coverage amounts, specific situations, and eligibility. They may not provide adequate protection for significant medical expenses, emergency evacuations, or extensive trip disruptions. Relying solely on credit card insurance can leave you vulnerable to substantial financial risks and logistical challenges. Make sure that you thoroughly review your credit card’s travel insurance policy, or any other policy you may currently have and seek additional coverage if necessary.
Client's Choice: The decision to purchase or decline travel insurance rests solely with the Client. However, it is mandatory for the Client to sign a waiver indicating that they have been offered insurance and that they declined it, before completing the booking. Travel insurance can always be added prior to travel departure. Some restrictions may apply.

8. Pricing Accuracy & Errors
While I strive for accuracy, errors in pricing or information may occur. In such cases, I reserve the right to correct any errors and adjust pricing accordingly. I will notify you of any such changes.
9. Force Majeure
I am not liable for any failure or delay in performing my obligations where such failure or delay results from any cause beyond my reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, strikes, natural disasters, epidemics, or pandemics.
10. Limitation of Liability
My Liability: To the maximum extent permitted by law, my liability for any claims arising out of or in connection with my Services is limited to the amount of the fees paid by you directly to me for my agency services.
No Liability for Suppliers: I am not liable for any loss, damage, injury, delay, or inconvenience caused by any Supplier or any third party.
Consequential Damages: I shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
11. Privacy Policy
Your privacy is important to me. My Privacy Policy explains how I collect, use, and protect your personal information. By using my Services, you agree to the terms of my Privacy Policy.
12. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles.
Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts located Dickson, Tennessee.
13. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14. Amendments
I reserve the right to amend these Terms and Conditions at any time without prior notice. The updated Terms and Conditions will be effective immediately upon posting on my website. Your continued use of my Services signifies your acceptance of the revised Terms.
